Attorneys for a Missouri man convicted in the 1989 death of an Ord woman have convinced a judge to delay his sentencing. In Howard County District Court today Judge Karen Noakes sustained a defense motion to delay sentencing for 46-year old John Oldson and ordered a hearing on a motion for a new trial.
Defense Attorney James Mowbray (moh’-bree) told the judge this afternoon that new evidence in the case may exonerate his client. Mowbry said the motion for new trial deals with a diary which purportedly details Cathy Beard’s death and that John Oldson did not kill her. Mowbry said the diary - which was not allowed during trial - should now be admitted as evidence.
He said the diary was allegedly written by Jean Backus and sent to Oldson’s family by Doug Olson. Mowbray said officials were unable to locate Olson during the trial – but he has since been arrested by U-S Marshall’s in Iowa and is now available to be subpoenaed. Prosecuting Attorney Corey O’Brien said the author of the diary is unknown and the question of whether it is fact or fake is still unanswered.
Judge Noakes set a hearing on the motion for new trial for May 6 and Sentencing has now been pushed back to June 3rd.
